El abogado del infante, desde la óptica del interés superior de los niños, niñas y adolescentes en México

La presente investigación tiene por objeto analizar la necesidad de la implementación de la figura del abogado del niño o asistencia técnica en el sistema jurídico mexicano, para salvaguardar los derechos de los niños, niñas y adolescentes, como un derecho humano al debido proceso, con ello, permitirles una participación directa en los procesos judiciales del orden de las familias en los cuales estén involucrados. Por lo tanto, se concluye que nuestra legislación nacional en materia de las familias, debe contemplar a la figura de abogado del niño—independientemente del abogado patrono y del ministerio público familiar—por ello, existe, la necesidad de esta figura, porque así el niño podrá tener una participación efectiva, siendo oído y escuchado en juicio, para hacer valer sus derechos inherentes a la infancia.

The present research aims to analyze the need for the implementation of the figure of the child’s attorney or technical legal assistance within the Mexican legal system, in order to safeguard the rights of children and adolescents as part of their human right to due process. This would enable their direct participation in family judicial proceedings in which they are involved. Accordingly, it is concluded that national family law legislation should incorporate the figure of the child’s attorney—distinct from both the legal representative and the family public prosecutor. The necessity of this legal figure arises from the imperative to ensure that children can participate effectively, be heard and listened to during legal proceedings, and assert their rights inherent to childhood
